TERMS AND CONDITIONS

Please read and understand our Terms and Conditions detailed below before booking a Tour and/or Retreat event. By asking us to confirm your booking, we are entitled to assume that you have read these Terms and Conditions and agree to them.

1. DEPOSIT
To confirm your booking with Yoga Tour and Retreat, you will be required
to pay A DEPOSIT OF 20% of the total price of your booking. A Booking
Confirmation email will be sent to you and the balance of the price of your
event must be paid by the date shown in it. However, if your booking is
made within 30 days or less of the event start date, then the full amount is
payable at the time of booking.

2. CANCELLATION FEE AMOUNT
Your fee is fully refundable if you cancel more than 45 days before the retreat start
date (minus bank transfers costs and charges)
If you cancel less than 45 days before the start of the retreat, the
deposit is non-refundable.
Only if you don’t turn up and don’t inform us that you are not coming, the
cancellation fee is the full retreat fee.

3. CANCELLATION BY US
We reserve the right to cancel a retreat under any circumstances, in which
case we will offer a full refund of all monies paid within 10 working days
(minus bank transfers costs and charges).

4. FINAL PAYMENT
Payment of the balance of the event price will normally become due 30
days prior to the event start date. However, in certain cases we will ask you to make the final payment on the first day of the event. If the balance is not paid by the due
date, which was intimated to you after the payment of first deposit, we reserve the
right to treat your booking as canceled.

5. TRAVEL DOCUMENTS (PASSPORT, VISAS, ETC)
For events outside of your home country, you must carry a valid passport
and have obtained all other required travel documents (visas, insurance,
permits, certificates etc.) for the country(ies) you will visit during your event.
We will send you a link to apply for a visa if it is needed. For many
countries, your passport must be valid for at least 6 months beyond the
duration of the event; please make sure to research the applicable passport
requirements for each country you plan to visit.
It is your responsibility to ensure that you are in possession of all such
required travel documents for your trip. We are not responsible if you are
refused entry to a country because you lack the correct travel documents.

6. TRAVEL INSURANCE
We strongly advise all our clients to purchase travel insurance in
connection with the event to cover sickness or an accident. While the
coverage provided by travel insurance varies based on the policy you
purchase, as a general rule, this type of insurance may provide coverage
for a variety of losses which a client may incur relating to a booking, illness,
injury, theft, lost or damaged property, etc. It is your responsibility to ensure
that your possessions are kept safe at all times. Be aware that each client
is 100% responsible for any losses, penalties, fees or other financial
consequences arising out of any booking or during the trip, or the
cancellation or interruption of any event (including, for example, costs
related to airline tickets and fees, passport fees, visa fees, medical
expenses, etc.).

7. YOUR DETAILS
To confirm your booking, you must provide us with certain personal
information. The type of information we may require includes, for example: Full name (as it
appears on passport), Passport number, Copy of passport photo page,
Date of Birth, etc.

8. INJURY OR ILLNESS PRIOR TO OR DURING THE TOUR
By participating in Retreat activities, including yoga classes, tours and
social outings, attendees retain control and direction over all their physical
activities and voluntarily assume full liability and accept the risk of harm,
including physical injury and discomfort as a result of any participation in
activities during the tour and retreat programme.
The tour guide, the retreat instructor, and the hosts accept no liability for
any injury or illnesses that occur to trainees during the tour or retreat
programmes. Everybody is required to have insurance, the participants as
well as the instructors and the tour guides.
The nature of a yoga retreat can have a certain level of interpersonal
physical contact during yoga classes and workshops. By participating in
this yoga activity, attendees voluntarily agree to this contact and
understand its professional nature. If you do not wish to have physical
contact, please inform the Yoga instructor prior to the first yoga asana
class.

9. WHAT’S INCLUDED IN THE TOUR’S PRICE
The price includes:
All accommodations as listed on our website under “THE FEE INCLUDES”
All meals as listed on our website under “THE FEE INCLUDES”
Yoga practices, excursions, round transfers to the locations as described
on our website under “THE FEE INCLUDES” and those additional items
such as entrance fees, guide fee listed on our website under “THE FEE
INCLUDES”

10. WHAT’S EXCLUDED IN THE TOUR’S PRICE
The price does not include:
Flights/Airfare to the starting point of your event. (Though we will be happy to
suggest the best flights/airfare from your location to the starting point of your event)
Excess baggage charges
Travel documents fees (passports, visas, etc.)
Travel insurance
Optional Activities
Gratuities
Personal expenses
Optional activities (other than excursions which are listed on our website as
“Included”) are not included in the event’s price, and do not form part of the
event or this Agreement.

11. ITINERARY
The itinerary listed for each tour represents a general plan for that event
(including the day-by-day schedule of activities). However sometimes
circumstances may arise which result in changes to the listed itinerary and
you will work accordingly with suppliers or coordinators to reschedule your
retreat plan. These changes may include, without limitation, delays and/or
partial or complete changes in the following: the itinerary, location of
lodging, modes or quality of transportation, etc. You understand and agree
that: your host or guide may make last-minute or on-site decisions to
address the changed circumstances and therefore reserves the right to
change the itinerary with or without notice to you. But we guarantee that we
will take all the decisions in the best interest of the group as a whole.

12. PHOTOS AND MARKETING
With respect to still photos and/or video footage from the event which
include(s) your image and/or name, you irrevocably grant us the right to
use those photos and/or footage for marketing and promotional purposes
(including, without limitation, on our website, in advertisements, marketing
materials and/or on our social media platforms), on a royalty-free basis,
throughout the world and in perpetuity. With respect to any still photos
and/or video footage from the event which were shot by you and posted on
Facebook, Instagram, Twitter or any other social media platform, you
irrevocably grant us the right to re-post those photos and/or footage on
Facebook, Instagram, Twitter or any other such social media platform, on a
royalty-free basis, throughout the world and in perpetuity. By agreeing to
these Terms and Conditions you give us full permission for this information to
be released.

13. IMMUNISATIONS | TRAVEL ADVISORIES | WARNINGS
Each client assumes full responsibility for verifying any requirements
relating to and/or obtaining any immunisations which may be necessary or
desirable for travel in the applicable country(ies) and/or region(s). Each
client also assumes full responsibility for researching the safety and
security conditions in the applicable country(ies) and/or region(s) during the
period of scheduled travel, and being aware of any applicable travel
advisories and/or warnings. Clients may also wish to consult a physician
who is knowledgeable about travel medicine and related medical issues in
the country(ies) and/or region(s) to be visited.

14. ALCOHOL / DRUGS POLICY
Consumption of Alcohol/Drug is STRICTLY PROHIBITED for the entire
duration of the retreat. Non-compliance of this condition will
result in immediate dismissal of the individual from the remaining part of the
event, with no refund being issued.

15. SPECIAL REQUESTS
If you have a special request, please inform us at the time of booking.
Though, we will try our best to accommodate your request but we cannot
guarantee that the request will be met and any failure to do so will not be a
breach of contract on our part.

16. THIRD PARTY OPERATORS ARE INDEPENDENT
CONTRACTORS
We, Yoga Tour and Retreat, do not own, operate or control any person or
entity that provides any goods or services for your event (“Third Party
Operators”), including any lodging facilities, airline, ground or water
transportation, tour operator, food service provider, etc. Rather, we agree
with Third Party Operators to provide all goods and services for your event;
and you understand that all Third Party Operators are independent
contractor(s), and not our affiliates or employees. In selecting Third
Party Operators, we do our best to seek out reliable suppliers and
contractors to provide the necessary travel-related goods and services.
Accordingly, in the absence of gross negligence by us, you understand and
agree that we shall not have any responsibility or liability for any acts or
omissions of any Third Party Operators in connection with your event.
Without limiting the foregoing, we will not be liable for any direct, indirect,
consequential or incidental damage, liability, injury, loss cost or expense
you may incur (including any claim relating to personal injury, illness, death,
property damage or loss, delay or other inconvenience) arising out of or by
reason of the acts or omissions of any Third Party Operator.

17. ASSUMPTION OF RISK
Our team is dedicated to providing a safe environment for all clients who
participate in our events. However, you must take responsibility for your
own behavior and safety. Furthermore, you understand and assume the

risks and hazards inherent in travel. These risks and hazards may include,
without limitation, delays, illness, injury, death or other unanticipated
happenings, and may be caused by force majeure circumstances, the
negligence of our team or other persons (including third party operators),
the intentional and/or criminal conduct of others or other circumstances.
Certain locations are remote and require additional travel time away from
city centers and towns; as such, medical attention may not always be
readily available or may be of inferior quality compared to what is available
at home. Also, you may be visiting places where the political, cultural and
geographical environment is very different from where you live, and
in some cases, these differences may present increased risks and/or
challenges. Therefore, it is your responsibility to acquaint yourself with all
available and relevant travel information for your destination and the nature
of your itinerary. You acknowledge and agree that your decision to travel is
made after having considered this information, and you expressly assume
the personal risks involved with such travel.

18. PRIVACY POLICY AND DATA PROTECTION
We will not share your contact information with any third-party agencies for
marketing solicitation purposes. Any personal information that you provide
to us will be used only for the service you requested. We do not
automatically capture or store personal data from visitors to the site.
We will collect the name and telephone number of an emergency contact
for you prior to every yoga retreat. We will use this information and contact
this person only for emergency reasons. We may disclose this person’s
name and telephone number to third parties such as our hosts of events,
our yoga teachers, or medical professionals if needed in an emergency. By
giving us this information, you consent to this disclosure. By giving us your
contact details, you agree that from time to time, we may contact you with
information about special offers or future yoga retreat packages. If you do
not wish to receive such information, please notify us. We will use your
mobile number for a potential WhatsApp group that we might create at the
start of the yoga tour and/or retreat to communicate with everyone in the
group. You agree to have your mobile number shared with other
participants of the yoga group, the yoga teacher as well as with the yoga
retreat organizers.

19. CHANGES TO THESE TERMS AND CONDITIONS
We may need to make changes to these terms and conditions from time to
time. Any changes can only be made by us and not any third party
member. We reserve the right to amend or improve these Terms and
Conditions without prior notification when it is deemed necessary or when
circumstances so warrant.

20. PARTICIPANT AGREEMENT
By agreeing to these Terms and Conditions, the Tour and
Retreat Participant agrees as follows:
“I am entirely responsible for my own personal safety, health, and mental,
physical, emotional, and general well-being during and after the Tour and
Retreat. I release Yoga Tour and Retreat Organisers and their
representatives, and any of their employees, assistants, and affiliates, of
any liability for any injuries or damages mentally or physically I might incur
during or after the Tour and Retreat. I understand that the Retreat is in no
way psychotherapeutic or medical in nature. The Retreat is not involved
with the treatment of disease of any kind and is in no way a substitute for
medical diagnosis or treatment. Retreat organizers and other Retreat
leaders and teachers do not treat, prescribe, or diagnose any illness,
disease, or any other physical or mental disorder. I release Retreat organizers and their
representatives and any of their employees, assistants, and affiliates from
any injuries or damages mentally or physically that I might incur during or
after this Retreat as a result of following any advice given to me on this
Retreat. I am entirely responsible for my personal safety, health, and well
being during the Tour and Retreat. I hold the Tour and Retreat Organisers
harmless for anything that might happen to me or to my possessions on
this Retreat. I understand that no health insurance or travel insurance is
provided by the Retreat organizers, and, if I requested to be insured, I have
to do this myself. I have read and understand the foregoing Tour and
Retreat Terms and Conditions.”
By agreeing to this Tour and Retreat Participant Agreement, the participant
releases the Tour and Yoga Retreat Organisers and its representatives
from all responsibility and liability. I understand and accept the Terms and
Conditions stated above.”
